Andrew Berk studied law at Essex University followed by a master’s degree at Kiel University before qualifying as a solicitor in 2002. He has specialised in Employment Law since 2006.
Andrew acts for both employees and employers in Employment Tribunal claims including Unfair Dismissal & Constructive Dismissal, Redundancy, all forms of Discrimination, Breach of Contract, Unlawful Deductions From Wages, TUPE, Equal Pay, Flexible & Part-Time Working, Automatic Unfair Dismissal, Trade Union Detriment and Whistleblowing.
His experience includes high-volume claims for Trade Union members in the banking and teaching sectors as well as defending insurance-covered Employment Tribunal claims for employers. Andrew has represented clients at Preliminary Hearings, Judicial Mediations as well as at Final Hearings. He also has experience of Employment-related claims in the High Court and County Court.
Case Highlights
Steer v Stormsure Ltd [2021] EWCA Civ 887 – Successfully defending the Respondent at the Employment Appeal Tribunal stage in this landmark case regarding whether there was a right to interim relief in Discrimination claims.
A successful Direct Disability Discrimination claim against a major multinational retailer leading to compensation of almost £100,000.
A successful claim in respect of a negligent job reference resulting in compensation of over £250,000.
Successfully defending a Local Authority in a high-value Unfair Redundancy Dismissal claim.
A successful Unfair Dismissal claim against a leading bank resulting in compensation of £50,000.

In relation to HR matters, Andrew advises on and prepares: Contracts of Employment; Staff Handbooks including Disciplinary and Grievance procedures; and Settlement Agreements.
He also does seminars and provides training in all areas of Employment Law.
Andrew is a member of the Employment Lawyers Association and also the Discrimination Law Association. He has written various articles on Employment Law matters for both legal journals and for newspapers.
