Spouse Visa Extension

Introduction

The earliest time that someone can apply for an extension on spouse visa would be 28 days before the date of expiry on the current visa. 

Most requirements under the Immigration Rules remain unchanged. The applicant must satisfy the Home Office. They must demonstrate that the relationship with the sponsoring partner remains unchanged.

The applicant is required to prove the relationship requirement, financial requirement, English requirement, accommodation requirement and immigration requirement when making spouse visa extension application. 

Application Requirements

  • The application must prove the genuine and ongoing relationship with the sponsoring partner. This relationship should continue. Specified evidence is required to prove to the standard required by the Home Office.
  • Secondly, the applicant and partner must prove they meet the minimum financial requirement of £18,600. Additionally, £3,800 is required for the first non-British child, and £2,400 for each additional child. This requirement remains the same as the requirement of spouse visa application.
  • Thirdly, the applicant and sponsor must prove they have adequate, non-overcrowded accommodation for staying in the UK.

English Language Requirement

Most requirements remain unchanged. However, for a spouse visa, the English requirement is A2 instead of A1. Applicants were not aware of this significant change in requirement which has resulted into the refusal of application.
