Parent Visa

If you wish to live in the UK to care for your child, you can apply for a parent visa. However, if you’re eligible to apply as a partner, you should do so rather than applying as a parent. To apply as a parent:

Eligibility Criteria

  • Your child must be under 18 when you apply or was under 18 when you were first granted leave and isn’t living an independent life.
  • Your child must be living in the UK and meet certain criteria (e.g., being a British or Irish citizen, settled in the UK, or having pre-settled status).

Parental Responsibility

You must have sole or shared parental responsibility for the child. If you share parental responsibility, the other parent must not be your partner and must meet specific eligibility criteria.

Evidence Needed

  • You need to prove your active role in your child’s upbringing, backed by evidence from sources like schools, courts, medical professionals, etc.
  • The evidence should show that you’re living with or caring for your child, and it should be less than 4 years old.

English Language and Financial Requirements

  • You must demonstrate good English language knowledge and financial self-sufficiency without claiming public funds.
  • If your child or other dependants live with you, you need to prove financial support for them as well.

Duration of Stay

  • If granted, you can stay in the UK for 2 years and 9 months under this visa. Extensions are available.
  • If extending or switching from another visa, you can stay for 2 years and 6 months.

Application Process

  • Apply online outside or inside the UK depending on your situation. You may need to complete Appendix 5.
  • If you cannot afford the fee, you can apply for a fee waiver.

In essence, if you meet the criteria and have evidence to substantiate your role in your child’s upbringing, you can apply as a parent to live in the UK and care for your child.
